SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 12 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. PREGNANCY 13 HELP ORGANIZATION GRANTS. 14 (a)(1) As used in this section, "pregnancy help organization" means a 15 nonprofit corporation or an organization exempt from federal income tax, 16 existing as of January 1, 2024, that: 17 (A) Seeks to provide a range of services to individuals facing an 18 unintended pregnancy with the intention of encouraging pregnant women to give 19 birth to their unborn children; 20 (B) Promotes infant and maternal wellness and/or reduces infant and 21 maternal mortality, by: 22 i) Providing nutritional information and/or nutritional counseling; 23 ii) Providing prenatal vitamins; 24 iii) Providing a list of prenatal medical care options; 25 iv) Providing social, emotional, and/or material support; or 26 v) Providing referrals for WIC and community-based nutritional services, 27 including but not limited to food banks, food pantries, and food distribution 28 centers; and 29 (C) Does not perform, prescribe, provide referrals for, or encourage 30 abortion or affiliate with any organization that performs, prescribes, 31 provides referrals for, or encourages abortion. 32 (2) As used in this section, a "pregnancy help organization" includes 33 without limitation: 34 (A) Organizations traditionally known as "crisis pregnancy organizations"; 35 (B) Maternity homes; 36 ### Page 16 As Engrossed: H3/12/25 H4/1/25 H4/10/25 HB1202 16 04-10-2025 16:59:30 JAP008 (C) Adoption agencies; and 1 (D) Social services agencies that provide material support and other 2 assistance to individuals facing an unintended pregnancy to help those 3 individuals give birth to their unborn children. 4 (b)(1) The Department of Finance and Administration shall create a grant 5 program to provide funding to pregnancy help organizations. 6 (2) Grant funds shall be disbursed directly to the pregnancy help 7 organizations from the Department of Finance and Administration. 8 (c)(1) The department shall promulgate rules to implement the disbursement of 9 the grant moneys from the Pregnancy Help Organization Grant Sub-Fund in the 10 Miscellaneous Agencies Fund Account. 11 (2) The rules shall include: 12 (A) A requirement that the entity requesting the grant monies submit a 13 plan describing how the entity will spend the grant moneys; and 14 (B) A statement that the funds shall not be disbursed all at once, but 15 in increments in accordance with the plan described in subdivision (c)(2)(A) 16 of this section. 17 (d) Each fiscal year the Department of Finance and Administration shall 18 file with the Legislative Council or, if the General Assembly is in session, 19 the Joint Budget Committee, a report summarizing the amount of all funding 20 given to each Pregnancy Help Organization and the purpose of the funds 21 awarded to each Pregnancy Help Organization. 22 (e) The provisions of this section shall be in effect only from July 1, 2024 23 2025, through June 30, 2025 2026. 24 25 SECTION 39. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 26 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 27 PROCEDURES - APPROPRIATION – INFRASTRUCTURE INVESTMENT & JOBS ACT OF 2021. 28 (i) All appropriation and expenditures for funding received for the 29 Infrastructure Investment & Jobs Act of 2021 shall be expended using the 30 Infrastructure Investment & Jobs Act of 2021 appropriation sections as 31 authorized in this Act. 32 (ii) Any state agency, constitutional office, or institution shall request 33 a transfer of appropriation, as provided in the Infrastructure Investment & 34 Jobs Act of 2021 appropriation sections of this Act, from the Chief Fiscal 35 Officer of the State, stating clearly the amount requested, purpose and any 36 ### Page 17 As Engrossed: H3/12/25 H4/1/25 H4/10/25 HB1202 17 04-10-2025 16:59:30 JAP008 additional information requested by the Chief Fiscal Officer of the State. 1 (iii) After reviewing a request, the Chief Fiscal Officer of the State may 2 deny, modify or approve the request based on the estimated amount of 3 appropriation needed and currently available, purpose, estimated funding 4 available and preferred spending priority. Upon approval or modification of a 5 request by the Chief Fiscal Officer of the State and after meeting the 6 requirements of subsection (iv) herein, the Department of Finance and 7 Administration shall establish the transfer of appropriation on the books of 8 the Department of Finance and Administration and the State Auditor, in 9 compliance with the applicable classifications of appropriations as 10 enumerated in Arkansas Code 19-4-521 through 19-4-525. 11 (iv) Any request approved as authorized in subsection (iii) herein, 12 including requests that establish a new commitment item or new appropriation 13 shall require prior approval by the Legislative Council or the Joint Budget 14 Committee during a regular session, fiscal session, or extraordinary session 15 of the General Assembly. 16 (v) Any Oversight and/or Steering Committee charged with overseeing 17 disbursement of funds and appropriation from funds received from the 18 Infrastructure Investment & Jobs Act of 2021 appropriation sections of this 19 Act shall coordinate with the Department of Finance and Administration as 20 needed to facilitate the approval requirements herein in a timely manner. 21 (vi) Any appropriation approved in the Infrastructure Investment & Jobs Act 22 of 2021 by the General Assembly shall only be used for: 23 1) The purpose and amount of planned expenditures as submitted for 24 approval to the General Assembly and, 25 2) In the event that expenditures or obligations do not fully expend 26 approved appropriation authority as authorized in this section, the excess 27 appropriation may not be utilized for any additional expenditures other than 28 the amount and purpose as submitted to and approved by the General Assembly. 29 (vii) The Chief Fiscal Officer of the State shall submit a monthly report 30 to the Legislative Council or the Joint Budget Committee during a regular 31 session, fiscal session, or extraordinary session of the General Assembly or 32 to a designated subcommittee listing all Infrastructure Investment & Jobs Act 33 of 2021 beginning balance of funds received, each appropriation approved as 34 authorized in subsection (v) herein with the date the appropriation is 35 established, state entity, purpose, amount, funding distributed, and 36 ### Page 18 As Engrossed: H3/12/25 H4/1/25 H4/10/25 HB1202 18 04-10-2025 16:59:30 JAP008 remaining balance. 1 (viii) Determining the maximum amount of appropriation each fiscal year is 2 the prerogative of the General Assembly. Further, the General 4 Assembly has determined that a state agency, constitutional office, or 5 institution may operate more efficiently if some flexibility is provided to 6 the state agency, constitutional office, or institution authorizing broad 7 powers under this section. Therefore, it is both necessary and appropriate 8 that the General Assembly maintain oversight by requiring prior approval of 9 the Legislative Council or Joint Budget Committee as provided by this 10 section. The requirement of approval by the Legislative Council or Joint 11 Budget Committee is not a severable part of this section. If the requirement 12 for approval by the Legislative Council or Joint Budget Committee is ruled 13 unconstitutional by a court of competent jurisdiction, this entire section is 14 void. 15 16 SECTION 40. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 17 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 18 PROCEDURES - APPROPRIATION – AMERICAN RESCUE PLAN ACT OF 2021. Upon approval or modification of a 31 request by the Chief Fiscal Officer of the State and after meeting the 32 requirements of subsection (iv) herein, the Department of Finance and 33 Administration shall establish the transfer of appropriation on the books of 34 the Department of Finance and Administration and the State Auditor, in 35 compliance with the applicable classifications of appropriations as 36 ### Page 19 As Engrossed: H3/12/25 H4/1/25 H4/10/25 HB1202 19 04-10-2025 16:59:30 JAP008 enumerated in Arkansas Code 19-4-521 through 19-4-525. 1 (iv) Any request approved as authorized in subsection (iii) herein, 2 including requests that establish a new commitment item or new appropriation 3 shall require prior approval by the Legislative Council during the extended 4 recess, beginning on May 1, 2021, of the 2021 Regular Session or during the 5 interim, or the Joint Budget Committee during a regular session, fiscal 6 session, or extraordinary session of the General Assembly. 7 (v) Any Oversight and/or Steering Committee charged with overseeing 8 disbursement of funds and appropriation from funds received from the American 9 Rescue Plan Act of 2021 Appropriation Sections of this Act shall coordinate 10 with the Department of Finance and Administration as needed to facilitate the 11 approval requirements herein in a timely manner. 12 (vi) Any appropriation approved in the American Rescue Plan of 2021 by the 13 General Assembly shall only be used for: 14 (1) The purpose and amount of planned expenditures as submitted for 15 approval to the General Assembly and, 16 (2) In the event that expenditures or obligations do not fully expend 17 approved appropriation authority as authorized in this section, the excess 18 appropriation may not be utilized for any additional expenditures other than 19 the amount and purpose as submitted to and approved by the General Assembly. 20 (vii) It is the intent of the General Assembly that funds received from the 21 American Rescue Plan of 2021 that are discretionary or are not required to be 22 spent for a different general or specific purpose may be considered to be 23 utilized to pay off existing debt service. The parameters for the selection 24 of debt service payments may consider the highest interest rate owed and with 25 priority given to the payment of Big River Steel General Obligations bonds 26 and GARVEE Department of Transportation bonds. 27 (viii) The Chief Fiscal Officer of the State shall submit a monthly report 28 biannually, July 15th and January 15th, to the Legislative Council during 29 the extended recess, beginning on May 1, 2021, of the 2021 Regular Session or 30 during the interim, or the Joint Budget Committee during a regular session, 31 fiscal session, or extraordinary session of the General Assembly or to a 32 designated subcommittee listing all American Rescue Plan Act of 2021 33 beginning balance of funds received, each appropriation approved as 34 authorized in subsection (v) herein with the date the appropriation is 35 established, state entity, purpose, amount, funding distributed, and 36 ### Page 20 As Engrossed: H3/12/25 H4/1/25 H4/10/25 HB1202 20 04-10-2025 16:59:30 JAP008 remaining balance. (i) In the event that sufficient 21 appropriation is not provided by the General Assembly, any state agency, 22 constitutional office, or institution may request a transfer of 23 appropriation, as provided in the C.A.R.E.S. Appropriation Section of this 24 Act, from the Chief Fiscal Officer of the State, stating clearly the amount 25 requested, purpose and any additional information requested by the Chief 26 Fiscal Officer of the State. 27 (ii) After reviewing a request, the Chief Fiscal Officer of the State may deny, 28 modify or approve the request based on the estimated amount of appropriation 29 needed and currently available, purpose, estimated funding available and 30 preferred spending priority. Upon approval or modification of a request by the 31 Chief Fiscal Officer of the State and after meeting the requirements of 32 subsection (iii) herein, the Department of Finance and Administration shall 33 establish the transfer of appropriation on the books of the Department of 34 Finance and Administration and the State Auditor, in compliance with the 35 applicable classifications of appropriations as enumerated in Arkansas Code 19- 36 ### Page 21 As Engrossed: H3/12/25 H4/1/25 H4/10/25 HB1202 21 04-10-2025 16:59:30 JAP008 4-521 through 19-4-525. 1 (iii) Any request approved as authorized in subsection (ii) herein, including 2 requests that establish a new commitment item or new appropriation shall 3 require prior approval by the Arkansas Legislative Council or if meeting in 4 Regular or Fiscal Session the Joint Budget Committee. 5 (iv) Determining the maximum amount of appropriation each fiscal year is the 6 prerogative of the General Assembly. This is usually accomplished by delineating 7 such maximums in the appropriation act(s). Further, the General Assembly has 8 determined that a state agency, constitutional office, or institution may 9 operate more efficiently if some flexibility is provided to the state agency, 10 constitutional office, or institution authorizing broad powers under this 11 section. Therefore, it is both necessary and appropriate that the General 12 Assembly maintain oversight by requiring prior approval of the Legislative 13 Council or Joint Budget Committee as provided by this section. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 22 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 23 CLASSIFICATION AND USE OF APPROPRIATIONS. The appropriations authorized in 24 the Marketing and Redistribution Section, hereof which are transferred to the 25 various agencies, as authorized in the Transfer Provision - Marketing and 26 Redistribution Section hereof, are to be used for the maintenance and general 27 operation of the benefiting agency and shall only be expended under the 28 provisions cited in Arkansas Code § 19-4-522, the same being the General 29 Accounting and Budgetary Procedures Law of Arkansas. Provided, however, no 30 appropriation authorized herein shall be expended for Conference and Travel 31 Expenses or Professional Fees and Services. 32 The provisions of this section shall be in effect only from July 1, 2024 33 2025 through June 30, 2025 2026. 34 35 SECTION 43. SPECIAL LANGUAGE. TRANSFER 1 PROVISION - MARKETING AND REDISTRIBUTION. The Department of Finance and 2 Administration shall, upon transfer to the agencies or institutions fund or 3 fund account of the proceeds derived from disposal of property by the 4 Marketing and Redistribution division for the benefit of various agencies, 5 transfer appropriation, as provided in the Marketing and Redistribution 6 Section, hereof in such amount as funds are deposited into the Property Sales 7 Holding Fund and transferred therefrom for the benefit of such agencies. 8 The provisions of this section shall be in effect only from July 1, 2024 9 2025 through June 30, 2025 2026. 10 11 SECTION 44. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 12 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 13 RESTRICTIONS - MISCELLANEOUS TRANSFERS. Nothing in this Act is to be 14 construed as an authority to transfer a like amount of current general 15 revenues to fund appropriations provided for in the Miscellaneous Transfers 16 Section of this Act. 17 The provisions of this section shall be in effect only from July 1, 2024 18 2025 through June 30, 2025 2026. 19 20 SECTION 45. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 21 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 22 RESTRICTIONS - TRANSFER PROVISIONS. The Department of Finance and 23 Administration shall transfer appropriation as provided in the Refund to 24 Expenditures line item of the Miscellaneous Transfers Section, hereof in such 25 amounts as funds are deposited into the State Treasury or financial 26 institutions for proceeds received from insurance policies for casualty 27 losses, overpayment of obligations, overpayment of salaries, over-allocation 28 of federal assistance, maturity or redemption of investments, and subrogation 29 payments received for workers' compensation claims paid, for the benefit of 30 various state agencies. In the event that there is not 4 sufficient appropriation provided for by the General Assembly for overtime 5 compensation pursuant to Arkansas Code § 19-4-1612 and related personal 6 services matching for any state agency for the period ending June 30, 2025 7 2026, said agency shall request a transfer from appropriations provided for 8 Overtime in the Miscellaneous Transfers Section, herein, from the Chief 9 Fiscal Officer of the State, stating clearly the amount required. Upon 10 approval of the Chief Fiscal Officer of the State, and after seeking prior 11 review by the Arkansas Legislative Council or Joint Budget Committee, the 12 State Auditor shall be notified as to the amount and the purposes for which 13 said appropriation is to be made. The appropriation shall be established 14 upon the books of the Department of Finance and Administration and the State 15 Auditor. Provided, further, that if desired, said appropriation shall be 16 supplemental to those regularly appropriated for such purposes by the General 17 Assembly for that agency. 18 The provisions of this section shall be in effect only from July 1, 2024 19 2025 through June 30, 2025 2026. 20 21 SECTION 47. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 22 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 23 CLASSIFICATION AND USE OF APPROPRIATIONS - REFUND TO EXPENDITURES. In the event that the 7 Chief Fiscal Officer of the State determines that the General Assembly has 8 not provided sufficient appropriation for the payment of Personal Services 9 for any office of an elected Constitutional Officer, including the Bureau of 10 Legislative Research, Division of Legislative Audit or the Judicial 11 Department, any state agency, office, board, commission, institution or 12 institution of higher education due to the enactment of this Act or any other 13 Act approved by the General Assembly which raises the compensation level or 14 required benefit matching costs of state employees, the agency, office, 15 board, commission, institution of higher education or other institution may 16 request a transfer from the appropriation provided herein from the Chief 17 Fiscal Officer of the State. Such request shall clearly state the amount 18 required, the fund or fund account from which the employees are currently 19 being paid, and such other information as may be required by the Chief Fiscal 20 Officer of the State that he or she deems necessary to make a decision 21 regarding the request. Upon the approval of the Chief Fiscal Officer of the 22 State, and upon review by the Performance Evaluation and Expenditure Review 23 Subcommittee of the Arkansas Legislative Council or Joint Budget Committee or 24 upon processing the request for elected Constitutional Officers and their 25 employees by the Chief Fiscal Officer of the State, the State Auditor shall 26 be notified as to the amount and the purposes for which said appropriation is 27 to be made. The Chief Fiscal Officer of the State shall have the authority 24 to establish such positions as necessary for State agencies to process 25 payroll through the Arkansas Administrative Statewide Information System for 26 federal and state tax reporting purposes as necessary to comply with the 27 United States Internal Revenue Code (IRC), 2001-Code-Vol, Sec 3401 and 28 Treasury Regulations §31.3401(c)-1(a) and §1.1402(c)-2(b), and others which 29 govern the reporting of income and payment of withholding and matching taxes 30 for personal services. The positions established shall not be considered as 31 part of the total number of authorized positions for an agency and shall only 32 be considered as placeholders for payments to individuals who are board or 33 commission members or elected officials of the State that do not otherwise 34 receive salaries or wages as defined in Arkansas Code § 19-4-521 for their 35 personal services. The establishment of such positions shall not exceed 250 2 positions in any fiscal year. 3 The provisions of this section shall be in effect only from July 1, 2024 4 2025 through June 30, 2025 2026. 5 6 SECTION 64. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 7 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 8 AUTHORIZED - ARKANSAS CHILDREN'S HOSPITAL. The Arkansas Children's Hospital 9 may request the Chief Fiscal Officer of the State to transfer funds made 10 available for the following by this Act sums not to exceed $1,000,000 for the 11 Arkansas Children's Hospital Burn Center, $700,000 for the Children's 12 Hospital Payments, $600,000 for the Reproductive Health Monitoring, and 13 $233,600 for the Intensive Care Nursery each fiscal year from the 14 Miscellaneous Agencies Fund Account to the Department of Human Services 15 Grants Fund Account. The transferred funds shall be used to match federal 16 funds used for supplemental Medicaid payments to Arkansas Children's 17 Hospital. 18 The Arkansas Children's Hospital may also request the Chief Fiscal Officer 19 of the State to transfer the sum not to exceed $1,000,000 each fiscal year 20 from the Miscellaneous Agencies Fund Account from funds made available by 21 this Act for the Intensive Care Nursery to the Department of Human Services 22 Grants Fund Account. The transferred funds shall be used to match federal 23 Medicaid funds for cost-based reimbursement for helicopter patient transport. 24 The provisions of this section shall be in effect only from July 1, 2024 25 2025 through June 30, 2025 2026. 26 27 SECTION 65. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 28 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 29 INNOVATION AND PROJECT DEVELOPMENT FUND TRANSFERS. The Department of 30 Transformation & Shared Services - Division of Information Systems is a cost 31 recovery agency subject to the requirements of the United States Office of 32 Management and Budget Circular A-87 Cost Principles for State, Local and 33 Indian Tribal Government (A-87) and Cost Principles for Developing Cost 34 Allocation Plans and Indirect Cost Rates for Agreements with the Federal 35 Government Implementation Guide for the Office of Management and Budget 36 ### Page 35 As Engrossed: H3/12/25 H4/1/25 H4/10/25 HB1202 35 04-10-2025 16:59:30 JAP008 Circular A-87 (ASMBC-10). To comply with these federal rules, it is necessary 1 to establish an Innovation and Project Development appropriation and general 2 revenue fund account within the Department of Finance and Administration - 3 Disbursing Officer for the Department of Transformation & Shared Services - 4 Division of Information Systems. This fund shall be used for state enterprise 5 innovation projects that would enhance the technology operations of the State 6 that cannot be cost allocated to federal programs. The Department of 7 Transformation & Shared Services - Division of Information Systems will 8 maintain documentation for projects billed for these purposes. Fund transfers 9 may be made from the General Revenue Fund Account, upon the approval of the 10 Chief Fiscal Officer of the State and prior review of the Arkansas 11 Legislative Council or Joint Budget Committee, to reimburse the Department of 12 Transformation & Shared Services - Division of Information Systems for the 13 amounts billed. 14 The provisions of this section shall be in effect only from July 1, 2024 15 2025 through June 30, 2025 2026. 16 17 SECTION 66. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 18 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 19 PROCEDURES – PERSONAL SERVICES EXTRA HELP. In the event that there is not 20 sufficient appropriation provided for by the General Assembly for payment of 21 personal services related to Extra Help for any state agency for the period 22 ending June 30, 2025 2026, said agency may request a transfer from 23 appropriations provided for Personal Services Extra Help in the Miscellaneous 24 Transfers Section herein, from the Chief Fiscal Officer of the State, stating 25 clearly the amount required. Upon approval of the Chief Fiscal Officer of 26 the State, and after seeking prior review by the Arkansas Legislative Council 27 or Joint Budget Committee, the State Auditor shall be notified as to the 28 amount and the purposes for which said appropriation is to be made. The 29 appropriation shall then be established upon the books of the Department of 30 Finance and Administration and the State Auditor. As referenced in Section 9 of Act 637 of 3 1995, the authorized funding for Intrastate Metro Planning Grants that are 4 evenly distributed among planning and development districts under the 5 Miscellaneous Grants and Expenses Section of this Act shall include the West 6 Central Arkansas Economic Development District. 7 The provisions of this section shall be in effect only from July 1, 2024 8 2025 through June 30, 2025 2026. 9 10 SECTION 68. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 11 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FUND 12 USAGE AUTHORIZED. The Arkansas Children’s Hospital President and C.E.O. may 13 request the Department of Human Services-Division of Medical Services to 14 retain in the Department of Human Services Grant Fund account an amount not 15 to exceed $1,000,000 for funds made available by the act to be used to match 16 federal funds used for supplemental Medicaid payments to Arkansas Children’s 17 Hospital. 18 The provisions of this section shall be in effect only from July 1, 2024 19 2025 through June 30, 2025 2026. 20 21 SECTION 69. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 22 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 23 PROCEDURES - MEDICAL MARIJUANA IMPLEMENTATION AND REGULATION. In the event 24 that sufficient appropriation is not provided by the General Assembly for 25 expenditures resulting from the implementation and regulation of the Arkansas 26 Medical Marijuana Amendment of 2016 for any state agency, pursuant to 27 Arkansas Code § 19-4-701 et seq., said agency shall request a transfer of 28 appropriation from the Chief Fiscal Officer of the State, stating clearly the 29 amount required. Upon approval of the Chief Fiscal Officer of the State said 30 appropriations shall be established upon the books of the Department of 31 Finance and Administration in compliance with the applicable classifications 32 of appropriations as enumerated in Arkansas Code §§ 19-4-521 through 19-4- 33 527. 34 The provisions of this section shall be in effect only from July 1, 2024 35 2025 through June 30, 2025 2026. 36 ### Page 37 As Engrossed: H3/12/25 H4/1/25 H4/10/25 HB1202 37 04-10-2025 16:59:30 JAP008 1 SECTION 70. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 2 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FUND 3 TRANSFER AUTHORITY. From time to time, the Chief Fiscal Officer of the State 4 may transfer from his or her books and those of the Treasurer of State and 5 the Auditor of State from the Medical Marijuana Implementation and Operations 6 Fund to various state agencies' funds the amounts necessary to fund the 7 expenses for the implementation, administration, and/or enforcement of the 8 Arkansas Medical Marijuana Amendment of 2016. 9 The provisions of this section shall be in effect only from July 1, 2024 10 2025 through June 30, 2025 2026. 11 12 SECTION 71. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 13 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. BLANKET 14 BOND PROGRAM. The Secretary of the Department of Finance and Administration 15 is authorized to transfer Appropriation between the Blanket Surety Bond 16 Program appropriations authorized for State Employees (Appropriation 2DM), 17 County Employees (Appropriation 2DN), Municipal Employees (Appropriation 2DP) 18 and Public School Employees (Appropriation 2DQ). 19 The provisions of this section shall be in effect only from July 1, 2024 20 2025 through June 30, 2025 2026. 21 22 SECTION 72. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 23 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 24 PROCEDURES - VARIOUS TEMPORARY APPROPRIATION FOR STATE AGENCIES AND 25 INSTITUTIONS. (i) In the event that sufficient appropriation is not provided 26 by the General Assembly for any state agency or institution, an agency or 27 institution may request a transfer of appropriation, as provided in the 28 Various Temporary Appropriation for State Agencies and Institutions 29 Appropriation Section of this Act, from the Chief Fiscal Officer of the 30 State, stating clearly the amount requested, purpose and any additional 31 information requested by the Chief Fiscal Officer of the State. 32 (ii) After reviewing a request the Chief Fiscal Officer of the State may 33 deny, modify or approve the agencies or institutions request based on the 34 estimated amount of appropriation needed and currently available, purpose, 35 estimated funding available and preferred spending priority. Upon approval 36 ### Page 38 As Engrossed: H3/12/25 H4/1/25 H4/10/25 HB1202 38 04-10-2025 16:59:30 JAP008 or modification of a request by the Chief Fiscal Officer of the State and 1 after meeting the requirements of subsection (iii) herein, the Department of 2 Finance and Administration shall establish the transfer of appropriation on 3 the books of the Department of Finance and Administration and the State 4 Auditor, in compliance with the applicable classifications of appropriations 5 as enumerated in Arkansas Code 19-4-521 through 19-4-525. 6 (iii) Any request approved as authorized in subsection (ii) herein, 7 including requests that establish a new commitment item or new appropriation 8 shall require prior approval by the Arkansas Legislative Council or if 9 meeting in Regular or Fiscal Session the Joint Budget Committee. 10 (iv) Any appropriation approved as authorized in this Section shall not be 11 carried forward to the next fiscal year and shall be identified as a change 12 level increase by the state agency or institution, if requested. 13 (v) Determining the maximum amount of appropriation for a state agency or 14 institution each fiscal year is the prerogative of the General Assembly. 15 This is usually accomplished by delineating such maximums in the 16 appropriation act(s) for a state agency or institution. Further, the General 17 Assembly has determined that a state agency or institution may operate more 18 efficiently if some flexibility is provided to the state agency or 19 institution authorizing broad powers under this section. Therefore, it is 20 both necessary and appropriate that the General Assembly maintain oversight 21 by requiring prior approval of the Legislative Council or Joint Budget 22 Committee as provided by this section. The requirement of approval by the 23 Legislative Council or Joint Budget Committee is not a severable part of this 24 section. If the requirement or approval by the Legislative Council or Joint 25 Budget Committee is ruled unconstitutional by a court of competent 26 jurisdiction, this entire section is void. 27 The provisions of this section shall be in effect only from July 1, 2024 28 2025 through June 30, 2025 2026. 29 30 SECTION 73. SPECIAL LANGUAGE — CODE AMENDMENT. Arkansas Code § 19-6-803(c), 31 concerning the Public Legal Aid Fund, is amended to read as follows: 32 (c) The fund shall be used for providing financial support for public 33 legal aid organizations and distributed as follows: 34 (1) Forty-five percent (45%) of the fund shall be paid to Legal 35 Aid of Arkansas; and 36 ### Page 39 As Engrossed: H3/12/25 H4/1/25 H4/10/25 HB1202 39 04-10-2025 16:59:30 JAP008 (2) Fifty-five percent (55%) of the fund shall be paid to the 1 Center for Arkansas Legal Services. 2 3 SECTION 74. SPECIAL LANGUAGE — CODE AMENDMENT. Arkansas Code Title 19, 4 Chapter 5, Subchapter 12, is amended to add an additional section to read as 5 follows: 6 19-5-1288. Drug Task Force Fund. 7 (a) There is created on the books of the Treasurer of State, the 8 Auditor of State, and the Chief Fiscal Officer of the State a miscellaneous 9 fund to be known as the "Drug Task Force Fund." 10 (b) The fund shall consist of: 11 (1) Moneys obtained from public or private grants or other 12 sources that are designated to be credited to the fund; and 13 (2) Any other revenues authorized by law. 14 (c) The moneys in the fund shall be used to distribute funds to all 15 drug task forces in the state that meet the eligibility criteria for a 16 disbursement and shall be disbursed to eligible drug task forces in the state 17 by the Secretary of the Department of Finance and Administration. 18 (d) To be eligible to receive a disbursement from the fund, a drug 19 task force shall: 20 (1) Meet the standards of the Arkansas Commission on Law 21 Enforcement Standards and Training; 22 (2) Provide an annual accounting of its seizures and arrests to 23 the Department of Finance and Administration; and 24 (3) Meet any additional standards established by the department 25 by rule under subsection (e) of this section. 26 (e) The department shall promulgate rules to implement this section, 27 including without limitation: 28 (1) Additional eligibility criteria, in consultation with the 29 Office of Prosector Coordinator and Drug Task Force Board, for a drug task 30 force to be eligible to receive a disbursement from the fund; and 31 (2) The process for a drug task force to submit eligibility 32 documentation for a disbursement, including without limitation documentation 33 illustrating eligibility under subsection (d) of this section. 34 35 SECTION 75. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 36 ### Page 40 As Engrossed: H3/12/25 H4/1/25 H4/10/25 HB1202 40 04-10-2025 16:59:30 JAP008 authorized by this act shall be limited to the appropriation for such agency 1 and funds made available by law for the support of such appropriations; and 2 the restrictions of the State Procurement Law, the General Accounting and 3 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 4 Procedures and Restrictions Act, or their successors, and other fiscal 5 control laws of this State, where applicable, and regulations promulgated by 6 the Department of Finance and Administration, as authorized by law, shall be 7 strictly complied with in disbursement of said funds. 8 9 SECTION 76. LEGISLATIVE INTENT. It is the intent of the General 10 Assembly that any funds disbursed under the authority of the appropriations 11 contained in this act shall be in compliance with the stated reasons for 12 which this act was adopted, as evidenced by the Agency Requests, Executive 13 Recommendations and Legislative Recommendations contained in the budget 14 manuals prepared by the Department of Finance and Administration, letters, or 15 summarized oral testimony in the official minutes of the Arkansas Legislative 16 Council or Joint Budget Committee which relate to its passage and adoption. 17 18 SECTION 77. EFFECTIVE DATE. Section 73 of this act is effective on 19 and after January 1, 2026. 20 21 SECTION 78. EMERGENCY CLAUSE. It is found and determined by the 22 General Assembly, that the Constitution of the State of Arkansas prohibits 23 the appropriation of funds for more than a one (1) year period; that the 24 effectiveness of this Act, except for Section 73, on July 1, 2025 is 25 essential to the operation of the agency for which the appropriations in this 26 Act are provided, and that in the event of an extension of the legislative 27 session, the delay in the effective date of this Act, except for Section 73, 28 beyond July 1, 2025 could work irreparable harm upon the proper 29 administration and provision of essential governmental programs.
