appropriation to the agency in question of funds to comply with the Rule (Reference
Arkansas Act 918 of 2005)

Subpart 1. Generally
25 CAR § 60-101. Introduction.
(a)(1) The Arkansas General Records Retention Schedule sets forth the minimum
retention requirements of records commonly found in state government.
(2) It is not intended to require the creation of such records but rather
establishes minimum retention requirements for records created or retained by a state
agency.
(3) This schedule is not intended to govern the retention of records that are
unique to individual agencies.
(b)(1) The records within this schedule are organized into the following seven (7)
record categories:
(A) General administrative;
(B) Meetings;

(C) Automated systems;
(D) Personnel and human resources;
(E) Fiscal;
(F) Legal; and
(G) Grants.
(2) These categories are logical in nature and are not intended to establish any
requirement for physical organization or operational handling, other than the specified
retention periods.
(3) The name of a record category may or may not correspond to the area or
section of an agency that handles the record.
(c)(1) The retention periods established in this schedule are minimum retention
periods.
(2) They are not intended to prevent individual agencies from establishing
longer retention periods for any of their records.
(3)(A) Regardless of the minimum retention periods stated within this
schedule, an agency may determine any of its records may:
(i) Be of permanent value to agency operations;
(ii) Have external requirements for perpetual retention; or
(iii) Be useful for the study of history.
(B) Such records should be kept permanently.
(4) Should any differences in retention periods be found between this schedule
and state or federal law, the applicable law will take precedence.
(d)(1) The retention periods of this schedule apply only to the official version of a
record.
(2) Duplicates of the official version have no retention requirements under this
schedule, even if the duplicates are found in different media.
(e)(1) In some cases, this schedule provides examples for record types in order to
help agencies identify records.
(2) Such examples are not intended to be all-inclusive.

(f)(1) This retention schedule addresses all record formats and media (i.e.,
electronic, paper, microfiche, etc.).
(2) The minimum retention requirement is determined by content, not by
format or media.
(g)(1) The Arkansas General Records Retention Schedule will be maintained by the
Arkansas Records Retention Workgroup.
(2) The workgroup is:
(A) Composed of approximately eighty (80) members from Arkansas state
agencies; and
(B) Facilitated by a member of the Department of Finance and
Administration.
(h)(1) State government refers to state agencies, boards, and commissions,
hereafter referenced simply as agencies.
(2) It does not include:
(A) Local, city, or county government;
(B) Public institutions of higher education;
(C) The judicial branch; or
(D) State constitutional offices.
(3) Reference Acts 2005, No. 918.

25 CAR § 60-102. Definitions.
As used in this part:
(1) “Automated system” means a computer configuration that, with all
necessary hardware and software, performs or can be used to perform necessary
business applications;
(2) “Copy” means a reproduction of any record, including a reproduction of a
previous reproduction;

(3) “Data element” means, in electronic record keeping, a logical record
component constituting one (1) separate item of information, such as:
(A) Name;
(B) Address; or
(C) Age;
(4) “Disposition” means any manner or method of changing the custody,
location, or physical state of records, including:
(A) Transfer;
(B) Microfilming;
(C) Duplication; and
(D) Destruction;
(5) “Format” means the arrangement of information for:
(A) Use;
(B) Viewing; or
(C) Storage;
(6)(A) “Freedom of Information Act of 1967” means the Arkansas state act
that outlines the rights of the public to access public records.
(B) Reference. Arkansas Code § 25-19-101 et seq.;
(7) “General Record Schedule” provides a minimum period of time that a
specific type of record must be preserved;
(8)(A) “Governing body”.
(B)(i) The Freedom of Information Act of 1967, Arkansas Code § 25-19-
101 et seq., applies to the "governing bodies" of "all boards, bureaus, commissions, or
organizations of the State of Arkansas".
(ii) Arkansas Code § 25-19-106(a).
(C)(i) A group that has ultimate decision-making or policy-making
authority is a governing body.
(ii) Arkansas Attorney General Opinion Nos. 1991-288, 1996-074,
1998-169, and 1999-407;

(9) “Media” or “medium” means physical material on which records
information may reside, including, but not limited to:
(A) Paper;
(B) Microfilm;
(C) Microform;
(D) Computer disks and diskettes;
(E) Optical disks; and
(F) Magnetic tapes;
(10)(A) “Official version” means the record kept by the organization
responsible for the authoritative copy.
(B) Note. A copy made of the original record may become the official
version;
(11) “Permanent record” means a record that has sufficient historical or other
value to warrant its continued preservation by the state or federal government beyond
the time it is needed for administrative, legal, or fiscal purposes;
(12) “Record” means information or data captured in any form and media; and
(13) “Strategic plan” means management document containing the long-term
objectives of an organization and a specific action plan for attaining these objectives.

(a)(1) Legal actions involving state agencies are handled by the Attorney General’s
office, primarily by Assistant Attorneys General assigned to each agency.
(2) Therefore, most records pertaining to legal actions are centralized under
the auspices of the Attorney General.
(3) However, many state agencies maintain separate files on:
(A) Legal matters pertaining to the agency;
(B) Informal letter opinions; and
(C) Formal opinions.
(b)(1) The following record retention periods reflect the retention of the official
record regardless of media.
(2) Copies used for specific legal, fiscal, or administrative purposes may be
either:
