# ACIN Agreements and Participation Terms The agreement folder contains **38 PDFs**: one unsigned draft ACIN Interagency Cooperation Agreement and 37 files whose produced filenames label them executed, partially executed, or part of an executed packet. Repeated MOU/intergovernmental-agreement records reduce to **27 named agency units** when Pope County 911 is counted separately from Russellville Police Department. Its central operational provisions are: - RMS data is to be centralized in a cloud platform where generative AI and machine learning will search and link incidents, people, suspects, and things; the same paragraph adds "(ONLY INCIDENT REPORT INFORMATION) Not to include investigative files" (pp. 1-2). - The board is to include one command-level member from each RMS-contributing agency, with equal operational votes; the Sixth Judicial District Prosecuting Attorney chairs for grant compliance and appoints the director (p. 2). - Each participating RMS agency supplies a liaison, and users must be CJIS-certified (p. 2). - The MOU says "[g]rant funding has been obtained" for the first three years, after which costs revert to member agencies unless more grant funding is located (p. 2). - ACIN must undergo an annual independent financial audit, apply the Third Agency Rule, establish a privacy policy, and refer FOIA requests concerning contributed data to the originating agency (pp. 3-4). > [!contradiction] Incident-only clause versus produced investigative services > The MOU's express limit—"ONLY INCIDENT REPORT INFORMATION" and "[n]ot to include investigative files" (`AGR-201_El_Dorado_PD_MOU_EXECUTED_2026-05-15.pdf`, p. 1)—conflicts with the manual's Tier 2 "Investigative Data" category and the LeadsOnline contract's case narratives, attachments, phone extractions, communications, movement, device, and location analysis ([[ACIN Policy and Operations Manual]], `POL-301_ACIN_Policy_and_Operations_Manual_REDACTED_2026-01.pdf`, p. 47; [[LeadsOnline Executed Contract]], `CON-001_LeadsOnline_Executed_Contract_2026-07-13.pdf`, pp. 15-17, 46-47). See [[T030 - ACIN Incident-Report-Only Scope vs Investigative Data Services]]. > [!contradiction] Obtained grant versus unawarded proposal > Section 5.1 says, "Grant funding has been obtained for the operation of the Network for the first three (3) years" (`AGR-201_El_Dorado_PD_MOU_EXECUTED_2026-05-15.pdf`, p. 2). The clearinghouse material conditions completion of the award form on receipt of funding, and the final custodian email says DOJ had not issued an award package or approved a final budget as of 2026-07-23 ([[ACIN Proposed Federal Grant and Budget]], `GRN-201_State_Clearinghouse_Signoff_Email_REDACTED_2026-07-06.eml`, plain-text body; Gmail message `19f93fc1866e1bee`). See [[T029 - ACIN Funding Obtained Language vs No Federal Award]]. ## Draft cooperation agreement `AGR-001_Interagency_Cooperation_Agreement_DRAFT_UNSIGNED_2026-03-07.pdf` invokes the Arkansas Interlocal Cooperation Act and proposes a separate cooperative framework. It differs from the MOU in several respects: - Funding is "anticipated through Congressionally Directed Spending" rather than obtained (p. 2). - It remains in effect indefinitely and uses a 90-day withdrawal period (p. 2). - ACIN becomes an "operational multi-jurisdictional network" once ten public agencies execute; it continues while at least five remain, and dissolution requires a two-thirds vote (p. 3). - Its board has one representative and one vote per participating agency, not only per RMS-contributing agency (p. 1). The draft's signature fields are blank (p. 3). It therefore documents a proposed legal structure, not adoption of that structure. ## Agreement-status mismatch `AGR-201` carries an El Dorado agency signature and a May 2026 execution date on its signature page. The later July 15 status table lists "El Dorado PD | Phase 2 | Not Signed" ([[ACIN Participant and Integration Status]], `STS-301_ACIN_Agency_Status_2026-07-15.pdf`, p. 1). Conversely, that table labels Bryant Police Department, Mountain Home Police Department, Pulaski County Sheriff's Office, and the Arkansas Attorney General's Office signed, although this 38-file folder has no standalone agreement bearing any of those names. > [!contradiction] Produced agreements versus status roster > The agreement files and the project-authored status table cannot both serve as a complete contemporaneous execution roster. El Dorado is the clearest direct conflict; several other "Signed" rows lack a correspondingly named standalone agreement in this production. See [[T032 - ACIN Participation Rosters and Agreement Status]]. ## Open questions / follow-ups - Obtain the executed master agreement roster, including current legal status, effective date, withdrawal, and data/access classification for each agency. - Obtain governing-body resolutions or other authority for each intergovernmental agreement where required. - Reconcile the MOU's 30-day withdrawal rule with the draft cooperation agreement's 90-day rule. - Identify whether the interagency cooperation agreement was ever adopted and whether its ten-agency operational threshold was met. - Produce the annual financial audit required by the MOU, or identify when the first audit becomes due.
