# T059 - Batesville Vendor-File Permission vs NCIC File Non-Sharing Clause
The January 2024 ACIC email and resulting MOU give materially different instructions about whether Batesville may pass the NCIC Vehicle File to its LPR vendor.
## Statement A
ACIC wrote: `"Once the file reaches his agency, he can share that file with your company for use only with his agency"` (`Part 2.eml`, 2024-01-23, text/plain body).
## Statement B
MOU paragraph 8 says: `"BPD will not share, distribute, or sell the NCIC Vehicle File (LPR Data File)"` (`
[email protected]_20240209_085543.pdf`, p. 1).
## Why it matters
The difference affects whether vendor ingestion is authorized, what CJIS controls attach, and how ACIC or BPD could audit the nightly-file process. Silently preferring one sentence would erase a document-level governance conflict.

`open`. The production contains no amendment, legal interpretation, executed vendor security addendum, or audit record that reconciles the instructions.
